ইসলামে বিয়ের রুকন বা খুঁটি তিনটি:

এক:

বিয়ে সংঘটিত হওয়ার ক্ষেত্রে সমূহ প্রতিবন্ধকতা হতে বর-কনে উভয়ে মুক্ত হওয়া। Marry যেমন- বর-কনে পরস্পর মোহরেম হওয়া; ঔরশগত কারণে হোক অথবা দুগ্ধপানের কারণে হোক। বর কাফের কিন্তু কনে মুসলিম হওয়া, ইত্যাদি।

দুই:

ইজাব বা প্রস্তাবনা: এটি মেয়ের অভিভাবক বা তার প্রতিনিধির পক্ষ থেকে পেশকৃত প্রস্তাবনামূলক বাক্য। যেমন- বরকে লক্ষ্য করে বলা যেতে পারে “আমি অমুককে তোমার কাছে বিয়ে দিলাম” অথবা এ ধরনের অন্য কোন কথা।

তিন:

কবুল বা গ্রহণ: এটি বর বা বরের প্রতিনিধির পক্ষ থেকে সম্মতিসূচক বাক্য। Marry যেমন- বর বলতে পারেন “আমি গ্রহণ করলাম” অথবা এ ধরনের অন্য কোন কথা। Marry

বিয়ে শুদ্ধ হওয়ার শর্তগুলো নিম্নরূপ:

(১) ইশারা করে দেখিয়ে দেয়া কিংবা নামোল্লেখ করে সনাক্ত করা অথবা গুণাবলী উল্লেখ অথবা অন্য কোন মাধ্যমে বর-কনে উভয়কে সুনির্দিষ্ট করে নেয়া।

(২) বর-কনে প্রত্যেকে একে অপরের প্রতি সন্তুষ্ট হওয়া। এর দলীল হচ্ছে-নবী (সাঃ) বাণী “স্বামীহারা নারী (বিধবা অথবা তালাকপ্রাপ্তা) কে তার সিদ্ধান্ত জানা ছাড়া

(অর্থাৎ সিদ্ধান্ত তার কাছ থেকে চাওয়া হবে এবং তাকে পরিষ্কারভাবে বলতে হবে) বিয়ে দেয়া যাবে না এবং কুমারী মেয়েকে তার সম্মতি ছাড়া (কথার মাধ্যমে অথবা চুপ থাকার মাধ্যমে) বিয়ে দেয়া যাবে না।

লোকেরা জিজ্ঞেস করল,ইয়া রাসুলুল্লাহ (সাঃ)! কেমন করে তার সম্মতি জানব (যেহেতু সে লজ্জা করবে)। তিনি বললেন,চুপ করে থাকাটাই তার সম্মতি।”[সহীহ বুখারী, (৪৭৪১)]

(৩) বিয়ের আকদ (চুক্তি) করানোর দায়িত্ব মেয়ের অভিভাবককে পালন করতে হবে।Marryযেহেতু আল্লাহ তাআলা বিয়ে দেয়ার জন্য অভিভাবকদের প্রতি নির্দেশনা জারী করেছেন।

আল্লাহ তাআলা বলেন: “আর তোমরা তোমাদের মধ্যে অবিবাহিত নারী-পুরুষদের বিবাহ দাও।”[সূরা নুর, ২৪:৩২] নবী সাল্লাল্লাহু আলাইহি ওয়া সাল্লাম বলেছেন:

“যে নারী তার অভিভাবকের অনুমতি ছাড়া বিয়ে করবে তার বিবাহ বাতিল, Marry তার বিবাহ বাতিল, তার বিবাহ বাতিল।”[হাদিসটি তিরমিযি (১০২১) ও অন্যান্য গ্রন্থকার কর্তৃক সংকলিত এবং হাদিসটি সহীহ]

(৪) বিয়ের আকদের সময় সাক্ষী রাখতে হবে। দলীল হচ্ছে- নবী সাল্লাল্লাহু আলাইহি ওয়া সাল্লাম বলেছেন, “অভিভাবক ও দুইজন সাক্ষী ছাড়া কোন বিবাহ নেই।” [তাবারানী কর্তৃক সংকলিত, সহীহ জামে (৭৫৫৮)]।

বিয়ের প্রচারণা নিশ্চিত করতে হবে। Marry দলীল হচ্ছে নবী সাল্লাল্লাহু আলাইহি ওয়া সাল্লামের বাণী- “তোমরা বিয়ের বিষয়টি ঘোষণা কর।”[মুসনাদে আহমাদ এবং সহীহ জামে গ্রন্থে হাদিসটিকে ‘হাসান’ বলা হয়েছে (১০৭২)]

বিয়ের অভিভাবক হওয়ার জন্য শর্তঃ

১. সুস্থ মস্তিষ্ক সম্পন্ন হওয়া।

২. প্রাপ্ত বয়স্ক হওয়া।

৩. দাসত্বের শৃঙ্খল হতে মুক্ত হওয়া।

৪.অভিভাবককে কনের ধর্মের অনুসারী হওয়া। সুতরাং কোন অমুসলিম ব্যক্তি মুসলিম নর-নারীর অভিভাবক হতে পারবে না। অনুরূপভাবে কোন মুসলিম ব্যক্তি অমুসলিম নর-নারীর অভিভাবক হতে পারবে না।

তবে অমুসলিম ব্যক্তি অমুসলিম নারীর অভিভাবক হতে পারবে, যদিও তাদের উভয়ের ধর্ম ভিন্ন হোক না কেন। কিন্তু মুরতাদ ব্যক্তি কারো অভিভাবক হতে পারবে না।

৫. আদেল বা ন্যায়বান হওয়া। অর্থাৎ ফাসেক না হওয়া। কিছু কিছু আলেম এ শর্তটি আরোপ করেছেন। অন্যেরা বাহ্যিক আদালতকে (দ্বীনদারিকে) যথেষ্ট ধরেছেন। আবার কারো কারো মতে,

যাকে তিনি বিয়ে দিচ্ছেন তার কল্যাণ বিবেচনা করার মত যোগ্যতা থাকলে চলবে।

৬.পুরুষ হওয়া। দলীল হচ্ছে নবী সাল্লাল্লাহু আলাইহি ওয়া সাল্লাম এর বাণী- “এক মহিলা আরেক মহিলাকে বিয়ে দিতে পারবে না। অথবা মহিলা নিজে নিজেকে বিয়ে দিতে পারবে না।

ব্যভিচারিনী নিজে নিজেকে বিয়ে দেয়।”[ইবনে মাজাহ (১৭৮২) ও সহীহ জামে (৭২৯৮)।

৭. বুদ্ধিমত্তার পরিপক্কতা থাকা। এটি হচ্ছে বিয়ের ক্ষেত্রে সমতা (কুফু) ও অন্যান্য কল্যাণের দিক বিবেচনা করতে পারার যোগ্যতা। Marry

ইসলামী আইনবিদগণ অভিভাবকদের একটি ক্রমধারা নির্ধারণ করেছেন। সুতরাং নিকটবর্তী অভিভাবক থাকতে দূরবর্তী অভিভাবকের অভিভাবকত্ব গ্রহণযোগ্য নয়।

নিকটবর্তী অভিভাবক না থাকলে অথবা তার মধ্যে শর্তের ঘাটতি থাকলে দূরবর্তী অভিভাবক গ্রহণযোগ্য হবে। নারীর অভিভাবক হচ্ছে- তাঁর পিতা।

এরপর পিতা যাকে দায়িত্ব দিয়ে যান সে ব্যক্তি। এরপর পিতামহ, যতই উর্দ্ধগামী হোক। এরপর তাঁর সন্তান। এরপর তাঁর সন্তানের সন্তানেরা, যতই অধস্তন হোক। এরপর তাঁর সহোদর ভাই। Marry এরপর তাঁর বৈমাত্রেয় ভাই।

এরপর এ দুইশ্রেণীর ভাইয়ের সন্তানেরা। এরপর তাঁর সহোদর শ্রেণীর চাচা। এরপর বৈমাত্রেয় শ্রেণীর চাচা। এরপর এ দুইশ্রেণীর চাচার সন্তানেরা।

এরপর মীরাছের ক্ষেত্রে যারা ‘আসাবা’ হয় সে শ্রেণীর আত্মীয়গণ। এরপর নিকটাত্মীয় থেকে ক্রমান্বয়ে দূরের আত্মীয়। যার কোন অভিভাবক নেই মুসলিম শাসক অথবা শাসকের প্রতিনিধি (যেমন বিচারক) তার অভিভাবক।

There are three pillars of marriage in Islam:

one:

Both the bride and the bridegroom should be freed from all obstacles in the event of marriage. For example, the bride and groom are engaged to each other;

Be it due to heredity or due to milk consumption. The groom is a Kafir but the bride is a Muslim, etc.

Two:

Izab or Proposition: This is the propositional sentence presented by the girl’s guardian or her representative. For example, addressing the bridegroom may say

“I give so-and-so to you” or something similar.

Three:

Acceptance: This is a statement of consent on the part of the bridegroom or the bridegroom’s representative. For example, the groom may say “I accept” or something similar.

The conditions for the marriage to be pure are as follows:

(1) Identifying by pointing or naming or mentioning qualities or by any other means specifying both the bride and the groom.

(2) Both the bride and groom are satisfied with each other. The evidence for this is – The Prophet (PBUH) said: “A single woman (widow or divorcee) should not be married without knowing her decision (i.e. the decision will be sought from her and she should be told clearly)

and a virgin girl without her consent (verbally or (by keeping silent) cannot be married. People asked, O Rasulullah (SAW)! How will I know his consent

(as he will be ashamed). He said, “His consent is to remain silent.” [Sahih Bukhari, (4741)]

(3) The guardian of the girl should fulfill the responsibility of signing the marriage contract. Since Allah Ta’ala has issued instructions to the guardians for marriage.

Allah Almighty says: “And marry the unmarried men and women among you.” [Surah Noor, 24:32] The Prophet, may God bless him and grant him peace, said:

“The woman who marries without the permission of her guardian, her marriage is void, her marriage is void, her Abolition of marriage.” [The hadith was compiled by Tirmidhi (1021) and other authors and the hadith is sahih]

(4) Witnesses must be kept during the contract of marriage. The evidence is that the Prophet, may God bless him and grant him peace, said, Marry

“There is no marriage without a guardian and two witnesses.” [Compiled by Tabarani, Sahih Jame (7558)].

Marriage promotion must be confirmed. The evidence is the saying of the Prophet, peace and blessings be upon him – “You announce the matter of marriage.”

Conditions for becoming guardian of marriage:

Achieving a healthy brain.

becoming an adult.

To be freed from the shackles of slavery.

Parents should follow the bride’s religion. So no non-Muslim person can be the guardian of a Muslim man or woman. Similarly,

no Muslim person can be the guardian of a non-Muslim male or female. However, a non-Muslim man can be the guardian of a non-Muslim woman, even if their religion is different. But an apostate cannot be someone’s guardian.

To be exemplary or just. That is not to be fasek. Some scholars have imposed this condition. Others hold the external court (deendari)

sufficient. According to some, he should be qualified to consider the welfare of the person he is marrying.

Being a man. The evidence is the saying of the Prophet –

“A woman cannot marry another woman.” Or the woman cannot marry herself. An adulteress marries herself.” [Ibn Majah (1782) and Sahih Jame’ (7298).

Having intellectual maturity. It is the ability to consider equality (kufu) and other welfare aspects in marriage.

Islamic jurists have prescribed a hierarchy of guardians. So guardianship of distant parent is not acceptable to have near parent. Marry

If there is no immediate guardian or if there is a deficiency in the condition, the remote guardian will be accepted. A woman’s guardian is her father.

Then the person to whom the father gives responsibility. Then grandfather, however upward. Then his child. Then his children’s children, however subordinate. Then his brother.

Then his elder brother. Then the children of these two classes of brothers. Then the uncle of his brother class. Then uncle of Baimatreya class. Then the children of these two classes of uncles. Then in the case of Mirach those who are ‘asaba’ are the relatives of that class.

Then from close relative to distant relative. One who has no guardian is the Muslim ruler or the ruler’s representative (such as a judge) is his guardian.
