কার ক্ষেত্রে “Scholar” অভিধা ব্যবহার করা সঠিক? “ইসলাম শিক্ষা”-র শিক্ষকের ক্ষেত্রে কি এই অভিধা ব্যবহার করা ঠিক হবে? নাকি শুধুমাত্র বড় পর্যায়ের শাইখদের ক্ষেত্রে? কারণ এ ইস্যুটি আমাদের দেশ নাইজেরিয়াতে সালাফিদের পরিমণ্ডলে আলোচনার কেন্দ্রবিন্দু।

আলেম, ফকীহ ও মুজতাহিদ এ উপাধিগুলো অভিন্ন অর্থ নির্দেশ করে। সেটা হচ্ছে- যিনি শরয়ি বিধানে পৌঁছার জন্য নিজের শ্রম ব্যয় করেন এবং শরয়ি দলিল থেকে বিধান নির্ণয় করার মত যোগ্যতা যার রয়েছে।

এর জন্য প্রয়োজন ইজতিহাদ করার প্রয়োজনীয় জ্ঞান হাছিল করা।Scholar তাই এই অভিধা (আলেম, মুজতাহিদ বা ফকীহ) তে অভিষিক্ত শুধু তাকেই করা যাবে যার মাঝে ইজতিহাদ করার শর্তাবলি পূর্ণ হয়েছে।

আলেমগণ এই শর্তগুলোর উপর গুরুত্বারোপ করেছেন যাতে করে ইলম ছাড়া আল্লাহ্‌র দ্বীনের ব্যাপারে কথা বলার দরজা যে কারো জন্য উন্মুক্ত না থাকে; হোক সে ছোট কিংবা বড়। তবে, আমরা এখানে শুধু দু’টো উদ্ধৃতি উল্লেখ করব। এ উদ্ধৃতিদ্বয়ের মধ্যে শর্তগুলো এসে যাবে:

প্রথম উদ্ধৃতি: শাওকানি (রহঃ) থেকে। তাঁর কথার সারাংশ হচ্ছে- পাঁচটি শর্ত:

প্রথম শর্ত: কুরআন-সুন্নাহ্‌র দলিলগুলো জানা থাকা।

সুন্নাহ্‌ মুখস্থ থাকা শর্ত নয়। বরং সুন্নাহ্‌র গ্রন্থগুলো থেকে সুন্নাহ্‌ বের করার যোগ্যতা থাকাই যথেষ্ট। সুন্নাহ্‌র জ্ঞানের মধ্যে বেশি গুরুত্বপূর্ণ হচ্ছে সুন্নাহ্‌র প্রসিদ্ধ গ্রন্থগুলোতে যা রয়েছে সেগুলো।

যেমন সহিহ বুখারী, সহিহ মুসলিম, সুনানে আবু দাউদ,Scholar সুনানে তিরমিযি, সুনানে নাসাঈ, সুনানে ইবনে মাজাহ এবং এগুলোর সম্পূরক গ্রন্থসমূহ।

এ হাদিসগুলোর মধ্যে কোনটা সহিহ, কোনটা যয়িফ (দুর্বল) এ বিষয়ে জ্ঞান থাকা।

দ্বিতীয় শর্ত: ইজমা সংঘটিত হওয়া মাসয়ালাগুলো জানা থাকা।

তৃতীয় শর্ত: আরবী ভাষায় পারদর্শী হওয়া।

আরবীর সবকিছু মুখস্থ থাকতে হবে এমনটি নয়। বরং অর্থ জানতে পারার মত সক্ষমতা থাকা এবং বিশেষ বিশেষ বাক্য-কাঠামো জানা থাকা।

চতুর্থ শর্ত: উসুলুল ফিক্‌হ এর জ্ঞান থাকা। কিয়াস উসুলুল ফিকহ্‌ এর অন্তর্ভুক্ত। কারণ উসুলুল ফিকহ্‌ হচ্ছে- বিধান নির্ণয়ের মূলভিত্তি।

পঞ্চম শর্ত: নাসেখ (রহিতকারী)Scholar ও মানসুখ (রহিত) জানা থাকা।

দ্বিতীয় উদ্ধৃতি: শাইখ মুহাম্মদ বিন উছাইমীন (রহঃ) থেকে:

তিনিও মুজতাহিদ এর শর্তাবলি উল্লেখ করেছেন। তাঁর উল্লেখকৃত শর্তাবলির সাথে শাওকানি (রহঃ) এর উল্লেখকৃত শর্তাবলির তেমন কোন পার্থক্য নেই। কিন্তু, তার উক্তি শাওকানি (রহঃ)-এর উক্তির চেয়ে বেশি সহজ। তিনি বলেন:

ইজতিহাদের কিছু শর্ত আছে; যেমন:

১। ইজতিহাদ করার জন্য যে দলিলগুলো জানা প্রয়োজন সেগুলো জানা থাকা। যেমন- আহকাম সংক্রান্ত আয়াতগুলো ও হাদিসগুলো।

২। হাদিস সহিহ ও দুর্বল হওয়া সংক্রান্ত জ্ঞান জানা থাকা। যেমন- হাদিসের সনদ ও রাবীদের পরিচয় ইত্যাদি।

৩। নাসেখ (রহিতকারী), মানসুখ (রহিত) ও ইজমা (ঐক্যমত) Scholar সংঘটিত হওয়া বিষয়গুলো জানা থাকা। যাতে করে, কোন কিছুকে মানসুখ বলে হুকুম না দেয় কিংবা ইজমা বিরোধী কোন হুকুমনা দেয়।

৪। যে দলিলগুলোর কারণে হুকুম পাল্টে যেতে পারে যেমন- তাখসিস (সীমাবদ্ধকরণ), তাকয়িদ (শর্তযুক্ত করণ) ইত্যাদি দলিলগুলো জানা থাকা। যাতে করে এগুলোর সাথে সাংঘর্ষিক কোন হুকুম না দেয়।

৫। শব্দের অর্থ নির্ণয়ের সাথে সংশ্লিষ্ট আরবী ভাষা ও উসুলুল ফিকহ এর যে জ্ঞানগুলো রয়েছে সেগুলো জানা থাকা।

যেমন- আম (সাধারণ), খাস (বিশেষ), মুতলাক্ব (শর্তহীন), মুকায়্যাদ (শর্তযুক্ত), মুজমাল (অ-ব্যাখ্যাত), মুবায়্যান (ব্যাখ্যাত) ইত্যাদি। যাতে করে শব্দের অর্থগত নির্দেশনার দাবী মোতাবেক হুকুম দিতে পারেন।

৬। এমন যোগ্যতা থাকা যে যোগ্যতা দিয়ে তিনি দলিল থেকে হুকুম নির্ণয় করতে পারেন।”[সমাপ্ত]

তিনি ব্যাখ্যাগ্রন্থে এ কথাও উল্লেখ করেছন যে, পূর্বের তুলনায় এখন হাদিস বের করা অনেক সহজ। হাদিসগুলো গ্রন্থবদ্ধ হয়ে যাওয়ার কারণে।

অতএব, যার মাঝে এ শর্তগুলো পরিপূর্ণ হবে তিনি-ই আলেম; যিনি দলিল থেকে শরয়ি হুকুম-আহকাম নির্ণয় করতে পারবেন। আর যে ব্যক্তির যোগ্যতা এর নীচে তাকে আলেম, ফকীহ বা মুজতাহিদ বলা সঠিক নয়।

খেয়াল রাখতে হবে: ‘আলেম’, ‘মুজতাহিদ’ বা ‘ফকীহ’ অভিধা একটি শরয়ি পরিভাষা। আলেমদের নিকট এর বিশেষ সংজ্ঞা ও শর্ত রয়েছে।

তাই এই পরিভাষা ব্যবহারে শিথিলতা করা নাজায়েয। যেমন- যে কেউ শরয়ি হুকুম-আহকাম নিয়ে আলোচনা করলে, কিংবা মাদ্রাসা বা ইউনিভার্সিটিতে ইসলামিক সাবজেক্টে

পড়লে কিংবা দাওয়াতের ময়দানে সক্রিয় থাকলে তার ক্ষেত্রে এই পরিভাষা ব্যবহার করা। হতে পারে কেউ একজন দায়ী, দাওয়াতের ময়দানে তাঁর অনেক অবদান রয়েছে; Scholar কিন্তু তিনি আলেমের স্তরে পৌঁছতে পারেননি।

আমরা আল্লাহ্‌র কাছে প্রার্থনা করছি তিনি যেন আমাদেরকে উপকারী জ্ঞান শিক্ষা দেন এবং আমাদের জ্ঞানকে বাড়িয়ে দেন।

আল্লাহ্‌ই সর্বজ্ঞ।

The titles Alem, Faqih and Mujtahid indicate the same meaning. That is – one who spends his labor to arrive at Shari’i rulings and who has the ability to deduce rulings from Shari’i documents.

For this, it is necessary to acquire the necessary knowledge to perform ijtihad. Therefore, only one can be anointed to this title (Alem, Mujtahid or Faqih) among whom the conditions for ijtihad have been fulfilled.

Scholars have emphasized these conditions so that the door is not open for anyone to talk about the Deen of Allah without knowledge; Be it small or big. However, Scholar we will mention only two quotes here. Terms will come between these quotes:

First quote: From Shaukani (RA). The essence of his words is – five conditions:

First condition: Knowing the documents of Quran and Sunnah.

Memorizing the Sunnah is not a requirement. Rather, it is sufficient to have the ability to extract the Sunnah from the books of the Sunnah. More important among the knowledge of the Sunnah is what is contained in the famous books of the Sunnah. Such as Sahih Bukhari, Sahih Muslim, Sunan Abu Dawud, Sunan Tirmidhi, Sunan Nasa’i, Sunan Ibn Majah and their supplementary books.

Knowing which of these hadiths are sahih and which are yaif (weak).

The second condition: knowing the issues on which Ijma is formed.

Third condition: Proficiency in Arabic.

It is not necessary to memorize everything in Arabic. Rather, having the ability to know meaning and knowing particular sentence-structures.

Fourth condition: Having knowledge of Usulul Fiqh. Qiyas is included in Usulul Fiqh. Because Usul al-Fiqh is the basis of ruling.

Fifth Condition: To know Nasekh (Abrogator) and Mansukh (Abrogator).

Second quote: From Shaykh Muhammad bin Uthaymeen (RA):

He also mentioned the terms of Mujtahid. There is no difference between the conditions mentioned by him and the conditions mentioned by Shaukani (RA). But, his saying is more simple than that of Shaukani (RA). He said:

Ijtihad has certain conditions; For example:

  1. Knowing the documents that are required to perform ijtihad. For example, the verses and hadiths related to Ahkam.
  2. Knowing about the authenticity and weakness of hadith. For example, the authenticity of the hadith and the identity of the rabbis etc.
  3. To know the matters of nasekh (abrogation), mansukh (abrogation) and ijma (unanimity). So as not to command something as Mansukh or to give any command against Ijma.
  4. To know the documents that can change the order such as Takhsis (restriction), Taqeed (conditionality) etc. So as not to give any command that contradicts them.
  5. Knowing the knowledge of Arabic language and Usulul Fiqh related to determining the meaning of words. Like- Am (General), Khas (Special), Mutlaq (Unconditional), Muqayyad (Conditional), Mujmal (Unexplained), Mubayan (Explained) etc. So that you can give orders according to the demands of the semantic guidance of words.
  6. having such competence as to enable him to deduce the decree from the document.”[End]

He also mentions in the commentary that extracting hadith is much easier now than before. Because the hadiths were written down.

Therefore, among whom these conditions will be fulfilled, he is a scholar; Who can determine the Shariah rulings from the document. And it is not correct to call a person whose qualifications are below that of a scholar, faqih or mujtahid.

Note: The term ‘Alem’, ‘Mujtahid’ or ‘Faqih’ is a Shariah term. Scholars have special definitions and conditions for it. Therefore, it is not permissible to relax in the use of this term. For example, to use this term in the case of someone who discusses Shari’i rulings, or studies Islamic subjects in a madrasa or university, or is active in the field of Da’wah. Maybe someone is responsible, he has many contributions in the field of dawat; But he could not reach the level of scholar.
